Terms of Service
The agreement between you and us when you use Prospen. Written to be read.
1. The service
Prospen searches public sources for potential commercial partners, checks them against the profile and rules you set, and returns a ranked list with the evidence behind each verdict. Discovery and verification are available today. Outreach from your own sending domain is in development and is not part of what you are paying for until we say it is available.
Prospen produces recommendations. Business decisions, contracts and commercial terms with any partner are yours.
2. Accounts
You need an account, you must give accurate details, and you are responsible for what happens under your credentials. Tell us promptly if you think an account has been compromised. You must be able to enter a binding contract on behalf of the business you represent.
3. Credits and billing
- 1 site partner = 1 credit. 1 creator = 3 credits.
- The contact is included in the price — you never pay twice to reach them.
- Disqualified, duplicate and failed finds are never counted.
- Credits roll over one month. Extra 100 credits for $79, never auto-charged.
Subscriptions are charged in advance for the period you choose and renew until you cancel. Cancelling stops the next renewal; it does not refund the current period, except under the Team guarantee below. Prices are shown on the pricing pageand may change with 30 days’ notice to existing subscribers.
Team guarantee. On the Team plan, if the partners delivered in your first 90 days were not worth the subscription, tell us inside those 90 days and we refund what you paid for that period.
A verdict is binary: qualified or disqualified. Rejecting a delivered qualified partner is a targeting signal that improves later runs; it does not return the credit.
4. Acceptable use
- Do not use Prospen output to send unsolicited bulk mail. Any outreach you send, from Prospen or elsewhere, must comply with the anti-spam and marketing laws that apply to you and to the recipient, including CAN-SPAM, GDPR and PECR where relevant.
- Do not resell, redistribute or republish partner lists as a data product. Agency plans may use the output for their own named client brands.
- Do not attempt to break, overload or reverse engineer the service, and do not use it to build a competing dataset.
- Do not use Prospen for anything illegal, or to target private individuals.
5. Your data and ours
You keep ownership of the profile information you give us and of the partner lists delivered to your account. You grant us the licence needed to run the service for you. We keep ownership of Prospen itself: the software, the scoring and verification methods, and the interface. Aggregated, de-identified statistics that cannot identify you or your partners may be used to improve the product.
Personal data is handled as described in the Privacy Policy.
6. Availability
We aim to keep Prospen available and to warn you about planned maintenance, but the service is provided as is, without a warranty that it will be uninterrupted or that any particular partner will be found in any particular market.
7. Liability
To the extent the law allows, neither party is liable for indirect or consequential loss, lost profits or lost business. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose.
8. Termination
You can cancel or delete your account at any time. We may suspend or close an account that breaches section 4, that has not been paid for, or where required by law. On closure you can export your lists for 30 days.
9. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from these terms or the service.
